Agreement

These Terms of Service govern your use of NewWaterHeater.com and any purchase you make, operated by [Legal entity name] ("we", "us"). By using the site or placing an order you agree to these Terms.

What we sell

We sell water heaters for delivery to and installation at residential properties in our Arizona service areas. Product descriptions, specifications and prices are provided by us and our supply partner; we work to keep them accurate but errors may occur. If a price or product is listed in error we may cancel the order and refund you in full.

Payment

You pay us the price of the water heater (plus any applicable sales tax) at checkout. Payments are processed securely by Stripe. Prices are in US dollars. Your order is confirmed once payment succeeds.

Installation by independent contractors

Installation is performed by independent, licensed plumbing contractors ("Installers") who are not our employees or agents. You choose your Installer at checkout. The flat-rate installation fee of $499 is paid directly by you to your Installer on install day and is not collected by us.

The flat-rate installation covers a standard like-for-like replacement. It does not include additional parts, permits, code-required upgrades (for example expansion tanks, seismic straps, venting, gas line or electrical changes, drain pans or pressure-relief piping) or other work your Installer determines is needed; any extra work is quoted and agreed directly between you and your Installer.

Your Installer is solely responsible for the workmanship, licensing, permits, insurance and any workmanship warranty for the installation. Any dispute about installation work is between you and your Installer, although we will try to help resolve it.

Scheduling and access

You choose an install date and time window at checkout, subject to your Installer's availability. You agree to provide safe access to the install location and to have an adult present. Missed appointments may need to be rescheduled with your Installer.

Product warranty

Water heaters are covered by the manufacturer's warranty as stated by the manufacturer. We do not provide any separate product warranty. To the extent permitted by law, we disclaim all other warranties, express or implied.

Cancellations and returns

Cancellations, returns and refunds are handled under our Cancellation & Returns policy, which forms part of these Terms.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid us for that order, and we are not liable for indirect, incidental or consequential damages, including damage caused by installation work performed by an Installer.

Installers

Installers who join our trusted installer program agree to separate installer terms, including any membership fee, licensing and insurance requirements and service standards. [Link or attach installer agreement].

Governing law

These Terms are governed by the laws of the State of Arizona. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, unless otherwise required by law.

Changes

We may update these Terms from time to time. The version in effect when you place an order applies to that order.
